These Terms of Service ("Terms") govern your access to and use of Archivez, operated by Open Kinetix d.o.o. ("Open Kinetix", "we", "us"), a company registered in the Republic of Serbia. By using Archivez you agree to these Terms. If you do not agree, do not use the service.
1. The service
Archivez is an AI-assisted information retrieval and conversation product. It lets users of a subscribing tenant organisation ask questions over their own connected content — uploaded documents and, optionally, Gmail messages from senders the user has chosen to index — and receive answers with source citations.
2. Eligibility and accounts
- Archivez is intended for business and professional use. You must be at least 16 years old.
- Accounts are provisioned by a subscribing tenant organisation. Your access is governed by both these Terms and any agreement your organisation has with Open Kinetix.
- You are responsible for keeping your credentials confidential and for activity under your account.
3. Acceptable use
You agree not to:
- Use Archivez in violation of any applicable law or regulation
- Attempt to circumvent access controls, tenant isolation, or per-tenant usage caps
- Upload content you do not have the right to process
- Use Archivez to generate content that is illegal, defamatory, harassing, or that infringes the rights of others
- Reverse engineer, scrape, or otherwise abuse the service
4. Your content
You retain all rights to content you or your organisation provides to Archivez ("Your Content"). You grant Open Kinetix a limited, non-exclusive licence to process Your Content solely to provide and operate the service, as further described in the Privacy Policy.
5. Gmail integration
If you connect Gmail through Google OAuth, you authorise Archivez to read messages from the senders you explicitly select, using the gmail.readonly scope. Archivez will not send, modify, or delete messages. You can revoke the connection at any time through Archivez settings or your Google Account permissions.
6. Intellectual property
The Archivez name, logo, software, and product are the property of Open Kinetix d.o.o. These Terms do not grant you any rights to Open Kinetix trademarks or intellectual property, beyond the right to use the service as described.
7. AI-generated content
Answers produced by Archivez are generated by large language models and may contain inaccuracies, omissions, or errors. You should verify outputs before relying on them for important decisions. Open Kinetix makes no guarantee that model-generated answers are accurate, complete, or fit for any particular purpose.
8. Service availability and changes
We strive to keep Archivez available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. For material changes that reduce functionality for paying tenants, we will give reasonable notice through tenant admins.
9. Fees and usage caps
Fees are governed by the agreement between Open Kinetix and your tenant organisation. Per-tenant monthly AI-inference caps may apply; your tenant administrator can view and adjust the cap within the configurable range in the Archivez administration panel.
10. Disclaimers
Archivez is provided "as is" and "as available". To the maximum extent permitted by law, Open Kinetix disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, Open Kinetix and its affiliates will not be liable for indirect, incidental, consequential, special, or exemplary damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of Archivez.
12. Termination
Either party may terminate access in accordance with the agreement between Open Kinetix and your tenant organisation. Upon termination, tenant data is deleted in accordance with the Privacy Policy.
13. Governing law
These Terms are governed by the laws of the Republic of Serbia. Disputes will be resolved in the competent courts of the Republic of Serbia, except that Open Kinetix may seek injunctive relief in any jurisdiction to protect its intellectual property.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced to tenant admins at least 30 days in advance. Continued use of Archivez after changes take effect constitutes acceptance.
